PT Bumi Serpong Damai, Tbk (“Sinar Mas Land”, “we”, “us”, or “our”), a publicly listed company established under the laws of Republic of Indonesia and engaged in real estate activities, respects your privacy. We are committed to provide utmost effort and to implement a policy that aim to protect and maintain the security of Personal Data in accordance with the principle of Law No. 27 of 2022 on Personal Data Protection and other relevant applicable laws and regulations, including their amendments from time to time (the “Applicable Regulations”).

This Privacy Policy applies to all Personal Data owners (data subjects), among others to our customers or prospective customers, employees, prospective vendors, vendors, visitors and users who use and/or visit our service/facility/product/property/engagement/applications/electronic systems/websites including but not limited to sinarmasland.com and its derivative sites, enter into an agreement with us, as well as any other third parties to which this Privacy Policy applies (“user(s)”, ”You”, or “Your”).

Users are encouraged to read this Privacy Policy to understand how we obtain, collect, process, analyze, store, correct, update, display, publish, transfer, disclose, delete or destroy Your Personal Data (“Personal Data Processing”).

A. Collection of Information

Sinar Mas Land gathers, collects, and stores specific and/or general personal data regarding individuals and/or company who are identified or can be identified separately or in combination with other information, either directly or indirectly through an electronic and/or non-electronic system (“Personal Data”), on users in the following areas:

1. Personal and contact details, including but not limited to full name, place and date of birth, identification card number, tax identification number, passport number, family certificate, birth certificate, prenuptial agreement, nationality, partner nationality (as necessary), address, telephone number, email address, marital status, family information, job-related information and/or company’s documents that You provide via sales form, booking letter, agreement, and other relevant documents;
2. Details of the purchase object, including but not limited to space residential, or apartment, office, shop-house, kiosk or land plot unit location, type, unit number, source of funds, purpose of purchase, payment method, and other related information;
3. Financial and tax-related information from financial institutions or companies, such as loan/credit history, defaults, financial situation and history (as relevant to the payment method) that we obtain from third parties;
4. Employment-related data and/or information, encompasses among other: (i) Your pre-employment screening data and/or information, such as data and/or information we obtained from Your resume or CV (i.e. education history and qualifications, working experiences, etc.), references from other party, credit checking; (ii) identification data, such as Your signature, employee number, photo, business email address; and/or (iii) information about Your job, salary, and benefits, such as Your position, job title, department, division, work location, start (and end) date, basic salary and bonus, bank account details;
5. The variety of information that user voluntarily submitted via the input forms, email, or chat within our applications/electronic systems/websites including but not limited to sinarmasland.com and its derivative websites, such as an information-requests, surveys, and/or site registrations, date and time of access to our websites including but not limited to sinarmasland.com and its derivative sites, the referring Internet Protocol (IP) address, and other aggregate or generic information on the website statistics, e.g. what web pages customers access or visit, etc; and
6. Your image recording through CCTV in Sinar Mas Land area and records of Your communications with us or our customer service via telephone number or via online services i.e. our smartphone and or website applications.

If there are other additional information or data that constitutes as Personal Data that we will collect from You, we will notify You with the mechanism in accordance with applicable laws and regulations in Indonesia, while still ensuring the protection of Your Personal Data based on this Privacy Policy.

B. Our Basis and Purpose in Using and Processing Personal Data

Sinar Mas Land uses the information for several purposes, including to:

1. for the performance of our contract with You in relation to our cooperation or engagement with You, the purchase of products, goods or services that You will or have purchased and/or any other contract that enables us to provide our products/services/facilities to You;
2. to process Your data or information in relation to our relationship with You, namely through cooperation, product or service transactions, based on the consent we obtain from You, including but not limited to through our forms and/or other relevant documents;
3. to keep Your information in our records and carry out the business administration. This processing is necessary for the fulfillment of our obligations in relation to perform of our contract with You. Once our contract has been completed, it is in our legitimate interest to maintain and develop our relationship with You;
4. for marketing purposes, namely offering products or services, including special offers, promotions, or information that may be of interest to users. Such marketing messages may be sent to user by Sinar Mas Land in various ways including but not limited to Your e-mail, short message service, telephone, facsimile, correspondence facilities and other official Sinar Mas Land information delivery media in accordance with and subject to the prevailing laws and regulations in Indonesia. User can make a request to Sinar Mas Land if user wants to stop to be contacted by Sinar Mas Land for such marketing purpose by contacting Sinar Mas Land as stated in this Privacy Policy. This processing is based on explicit consent obtained directly from the user and/or fulfilment of obligations in the performance of the contract;
5. to comply with regulatory or other legal requirements such as reporting to regulatory authorities and further examination by authorized parties and in accordance with applicable laws in Indonesia. This processing is necessary for the fulfilment of our legal obligations in accordance with statutory provisions; and
6. to design and provide our products and services also to conduct research and statistical analyses including the use of new technologies. This processing is necessary for the fulfilment of our legitimate interests of designing and improving our products or services, providing value-added services, developing our business and gaining insight into how our products/services/facilities are used.

Further, Sinar Mas Land uses the information for internal purposes, including to measure various statistics of sinarmasland.com in order to improve its quality and user experience. Information collected through opt-in and voluntary submissions are used to support the Sinar Mas Land internal analysis/reports and to better understand customer interests and provide appropriate feedback and services to the requestor, such as marketing/product information, regular subscribed reports, employment opportunities information, etc. This processing is necessary for the fulfillment of our legitimate interests.

Sinar Mas Land will not distribute and make available any information collected from You to any organizations or companies other than its parents, subsidiaries, affiliates and their respective directors, officers, employees, advisers, consultants, and agents, vendors and/or other third parties for purposes set out in the contract and/or engagement.

We may process Your Personal Data in countries other than Your place of residence. When transferring Your Personal Data for such processing, we will ensure that the recipient country has a level of Personal Data protection that is equivalent to or higher than the standard of Personal Data protection in Indonesia. However, if the recipient country has a lower level of Personal Data protection, we will use adequate and binding protection measures, such as through contracts, provisions and/or other written instruments (as applicable and feasible).

Sinar Mas Land takes reasonable steps to protect the information users share with Sinar Mas Land from unauthorized use, access, and disclosure, both during transmission and at rest. However, no transmission of information via the internet nor electronic storage solution can be entirely secure, therefore please be aware that Sinar Mas Land cannot guarantee absolute security.

Sinar Mas Land uses and reserves the right to use third party advertising companies to serve ads on our behalf across the internet. These third-party advertising companies may employ cookies and various other technologies such as web beacon technology to measure and improve the effectiveness of ads for their clients. Cookies are bits of electronic information that can be transferred to Your computer or other electronic device to uniquely identify your browser. When You use our website, we and our partners may place one or more cookies on Your computer or other electronic device or use other technologies that provide similar functionality. As a data subject, You can exercise Your rights under the Applicable Regulations, such as submitting requests to us or a data protection authority, as well as addressing other rights related to how we use Your data, subject to any exceptions outlined herein and those regulations.

Further, please be informed that the data controller is Sinar Mas Land. We may monitor or record calls or other communications we have with You for training, security, or quality checking.

D. Actions You Can Take

Products/Services/Engagement/Facilities

As relevant for You, to access and use our products/services/engagements/facilities or engage in cooperation with us, You can refer and complete the agreement, form, application letter, and/or other documents that we have provided to You or relevant to You (“Relevant Documents”), also provide Your consent to us by providing the necessary information and signing the Relevant Documents.

Without prejudice to the provisions contained in this Privacy Policy and/or applicable law and regulation, if you decide to withdraw Your consent to engage with us and/or access our products/services/engagements/facilities, You will need to submit a termination request form. Such form can be obtained by reaching out through one of the channels listed in the Contact Us section.

Exercise of Your Rights

To exercise Your rights, such as obtaining access and/or copies, submitting objections, verification, correction Personal Data, and/or withdrawing consent related to our products/services/engagements/facilities, You should submit a request by contacting one of the channels listed in the Contact Us section. We will strive to process Your request and provide confirmation within the period stipulated by the Applicable Regulations.

Any exercise of Your right as a data subject regarding alleged violations by Sinar Mas Land of Your Personal Data Processing must be submitted in writing to Sinar Mas Land. This would be done in accordance with the terms and conditions required in the Applicable Regulations, which further, Sinar Mas Land will strive to address and/or respond to the request timeframe allowed by the Applicable Regulations. If there is any dispute in the interpretation and implementation of this Privacy Policy, the settlement will initially be resolved through deliberation to reach consensus. In the event the deliberation does not result in consensus, the dispute will be resolved through and You agree to choose the Tangerang District Court as the legal domicile for both Sinar Mas Land and Yourself.

Sinar Mas Land has the right to refuse Your request to access, correct and/or erase, some or all of Your Personal Data held by us, if permitted or required under applicable laws and regulations, including for the purposes of law enforcement.

E. Storage, Usage, Retention, and Protection of Personal Data

The using and processing of Your Personal Data will be conducted for as long as You are our user. Subsequently, we will retain Your Personal Data for as long as necessary to fulfill the purposes outlined in this Privacy Policy and will store it in accordance with our retention policy, that is for a period of 10 (ten) years unless a longer retention period is required or permitted by law (“Retention Period”).

Sinar Mas Land are committed to ensuring the security of Your Personal data throughout its processing, including during the Retention Period or thereafter. We employ reasonable measures to protect Your Personal Data from unauthorized access, collect, use, disclosure, modification, as well as from unlawful processing, accidental loss, destruction, and damage, including by limiting the access to Your Personal Data. Access to Your Personal Data is restricted to authorized parties on a need-to-know basis. Those handling Your Personal Data are required to process it only in a lawful manner, maintain its confidentiality.

If there be any unauthorized access or activities compromising the confidentiality of Your Personal Data that are beyond our control, we will inform You immediately to help You address and minimize any potential risks.

F. Erasure and Destruction of Personal Data

In accordance with applicable laws and regulations or our retention policy or upon Your request, we could erase and/or destroy the user’s Personal data from our system to ensure the Personal Data shall no longer be used, except in the case of:

1. We deem it necessary to retain Your Personal Data for longer to fulfill a legal obligation (e.g. evidentiary purposes related to tax, audit, accounting, etc.) or in certain circumstances; and/or
2. Your Personal Data is still within the Retention Period as we have mentioned above.

When deleting and/or destroying Personal Data, we will use reasonable measures to ensure that Your Personal Data is deleted, destroyed, and made practically unrecoverable, especially for electronic documents. The specific method of erasure will vary based on the Personal Data being erased, how it was collected and stored.

If You submit a request for partial or complete erasure/destruction of Your Personal Data, consequently, there may be possibility that You will not be able to engage with us and/or access/receive use our products, services, or facilities.
